Unauthorised encampment injunction

In 2019, Thurrock Council applied to the High Court for an injunction preventing unauthorised encampments. The injunction was discharged on 8 February 2024.

Hearings, 2019

The first hearing took place on Wednesday 31 July 2019. The hearing allowed for the service of the papers to commence on:

  • 107 named defendants
  • each of the sites that are to be protected against unauthorised encampments

Documents were made available online and posted at all sites that are subject to the injunction.

The claim for an interim injunction was heard on 3 September 2019 in the High Court of Justice, Royal Courts of Justice, Strand, London.

Amendment, 2021

Following the Order of Mr Justice Nicklin dated 24 May 2021, the interim injunction currently held by Thurrock Council was amended. The Interim Injunction originally contained a power of arrest against persons unknown. The power of arrest against persons unknown was discharged by the Order dated 24 May 2021, but it remained in place against the named individuals.

Amendment papers were published online.

Case management hearing, 2022

The case management hearing took place at the High Court on 27 May 2022. This hearing set directions for a final hearing against persons unknown. Papers and correspondence relating to the hearing can be downloaded below.

Directions order and notice of trial date, 2022

On 27 May 2022, a Directions Order was issued giving 'directions to final hearing'. Notice was given in June 2022 that the trial date would be 27 July 2022. A copy of the Directions Order and the notice of trial date can be downloaded below.

Amended interim injunction order, 2022

On 4 August 2022, Mr Justice Nicklin amended and extended the interim injunction against persons unknown, until such time as he makes a final decision on persons unknown. The amended interim injunction order, including schedules 2 and 3, can be downloaded below. Schedule 1 referred to within the Order is not applicable to persons unknown.

Discharge of injunction and discontinuance of proceedings, 2024

The injunction has been discharged by the Court and ceased to have effect from 8 February 2024.

A notice of discontinuance of proceedings was issued on 23 April 2024.
